Terms of Service
These Terms govern access to KeenClimb. By creating an account, starting a subscription, or allowing a child to use a profile under your account, you agree to these Terms on behalf of yourself and the children you supervise.
Eligibility and family responsibility
- Only adults aged 18 or older may create and manage KeenClimb accounts.
- You must provide accurate account, consent, and billing information and keep it up to date.
- You are responsible for all activity under your account and child profiles, including choosing appropriate settings and supervising use.
- You must keep login credentials confidential and notify us promptly if you suspect unauthorized access.
- A child may use KeenClimb only through a child profile created or approved by a parent or legal guardian.
What KeenClimb provides
- KeenClimb provides adaptive lessons, learning progress tracking, parent dashboards, support preferences, and offline-capable lesson experiences.
- The platform may recommend lessons, reviews, remediation, and pacing based on a child profile's progress and settings.
- Lesson content is educational support, not a substitute for school instruction, professional tutoring, medical advice, psychological advice, or special-education evaluation.
- We may add, change, reorder, or remove lessons, features, assessments, plans, and availability to improve the service or meet legal, safety, or operational requirements.
- Some features may be labeled beta, preview, pilot, or experimental and may change or end at any time.
Subscriptions, trials, cancellation, and refunds
- Free and paid plans may include different child-profile limits, lesson access, analytics, support, or offline features.
- Paid subscriptions are billed through Stripe or another payment processor shown at checkout.
- Unless the checkout page says otherwise, paid subscriptions renew automatically until cancelled.
- You can cancel from account settings or through the billing flow. Cancellation normally takes effect at the end of the current paid period.
- Refunds are available within 14 days of the initial purchase unless required otherwise by applicable law or a specific written offer.
- Taxes, currency conversion, payment failures, chargebacks, and processor rules may affect billing access and timing.
Acceptable use
- Use KeenClimb only for lawful personal, family, educational, or approved organizational learning purposes.
- Do not copy, scrape, bulk download, resell, sublicense, frame, or commercially exploit lesson content, UI, datasets, or platform outputs without written permission.
- Do not attempt to bypass authentication, rate limits, plan limits, age gates, parental consent, security controls, or access restrictions.
- Do not upload, submit, or transmit harmful code, unlawful content, abusive material, or personal data you do not have the right to provide.
- Do not use the service to build a competing model, dataset, product, or service unless we have agreed in writing.
- Do not interfere with other users, infrastructure, monitoring, or security systems.
Content and intellectual property
- KeenClimb and its licensors own the platform, software, lesson structure, visual design, curriculum materials, trademarks, and other protected content.
- We grant you a limited, revocable, non-transferable license to use KeenClimb for the plan and purpose you selected.
- You keep ownership of information you submit, but you grant KeenClimb the rights needed to host, process, display, secure, and operate it for the service.
- Feedback or suggestions may be used without obligation to you, while personal data remains handled under the Privacy Policy.
Safety, moderation, and suspension
- We may limit, suspend, or terminate access if we reasonably believe an account violates these Terms, creates security risk, harms users, abuses the service, or creates legal exposure.
- We may remove or disable content, lesson access, or features to protect children, comply with law, prevent misuse, or maintain service reliability.
- We may preserve records where required for security, legal compliance, billing disputes, or abuse investigations.
- You may stop using KeenClimb at any time, and you may request deletion as described in the Privacy Policy.
Disclaimers and limitation of liability
- KeenClimb is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted access, error-free lessons, specific academic results, grade improvements, test scores, or eligibility outcomes.
- To the maximum extent allowed by law, KeenClimb is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages.
- To the maximum extent allowed by law, our total liability for claims relating to the service is limited to the amount you paid to KeenClimb in the 12 months before the event giving rise to the claim.
- Some jurisdictions do not allow certain warranty disclaimers or liability limits, so parts of this section may not apply to you.
Changes to these Terms
- We may update these Terms when the service, law, or business requirements change.
- Material changes will be communicated through the service, by email, or by another reasonable method before they take effect where required.
- Continuing to use KeenClimb after an update takes effect means you accept the updated Terms.
- If you do not agree to updated Terms, you must stop using the service and may cancel your subscription.
